HS Code 2402Cigars, cheroots, cigarillos and cigarettes; of tobacco or of tobacco substitutes
3 six-digit codes · Heading 2 of 4 in Chapter 24 · World Customs Organization Harmonized System
HS code 2402 is where finished smoking products are classified for customs. Think of cigars you can light and cigarettes you can buy in a pack, whether the filling is tobacco or a substitute.
“Cigars, cheroots, cigarillos and cigarettes; of tobacco or of tobacco substitutes” divides three ways under heading 2402 — 240210, 240220 and 240290. Each carries its own customs description, and the exact wording below is what a classification has to match. The heading is number 2 of 4 in Chapter 24, Tobacco and manufactured tobacco substitutes; products, whether or not containing nicotine, intended for inhalation without combustion; other nicotine containing products intended for the intake of nicotine into the human body, which runs to 16 six-digit codes in all.
Six-digit codes under heading 2402

What HS code 2402 covers
Use this heading for goods that are ready to smoke. Raw leaf, tobacco waste and loose prepared tobacco belong elsewhere in the chapter.
The Harmonized System is a shared naming scheme for traded goods. Countries agree on the first six digits and add their own digits after that. HSN code 2402 and HTS 2402 are national versions that begin with the same four digits.
Good tariff classification starts with two plain facts about the product. What is it, and what is it made of? The sections below walk through both questions.
Cigars, cigarettes and substitutes: how the six-digit codes differ
Heading 2402 splits on product form first. Cigarettes have one code of their own, 240220. Everything cigar-like sits in the other two codes.
240210 and 240290 are mirror images. They describe the same kind of cigar-type goods. The only difference is the filling. One code is for tobacco. The other is for tobacco substitutes.
Notice that 240220 names tobacco only. If you ship cigarettes, check the filling carefully and compare the wording of the codes before you choose.
How to choose between 240210, 240220 and 240290
Work through the choice in order.
Step one is the product form. A cigarette points to 240220. A cigar, cheroot or cigarillo points to 240210 or 240290.
Step two is the filling. Real tobacco means 240210 for cigar-type goods. A substitute means 240290.
Step three is the weight rule. The cigar-type codes count the weight of every band, wrapper or attachment. Those parts are counted as part of the product. They are not extras that you can leave out.
These are six-digit codes. Many countries extend them with more digits into national tariff lines. The importing country sets the exact line and any duty, so check it there. If you are unsure, the HS code classifier can help you narrow down a product before you file.
2402 vs 2401, 2403 and 2404
Heading 2401 is for tobacco in its raw state, plus tobacco refuse. If the leaf has not been manufactured, it does not belong in 2402.
It also holds homogenised or reconstituted tobacco, plus extracts and essences. So the difference between HS 2402 and 2403 comes down to the finished form. Cigars and cigarettes go to 2402. Other prepared tobacco goes to 2403.
Heading 2404 is about products used for inhalation without combustion, and other nicotine products taken into the body. If a product does not burn when used, read the 2404 wording before you settle on 2402.
