What HS code 2401 covers: unmanufactured tobacco and tobacco refuse

Its official name is "Tobacco, unmanufactured; tobacco refuse". In everyday trade, people call these goods raw tobacco or leaf tobacco. The heading also covers tobacco refuse, which is the waste left over from tobacco.

You may see this heading written as HSN code 2401 or HTS code 2401. All of these names point to the same four-digit heading in the Harmonized System. Countries share the first six digits and may add more digits for their own customs tariff classification.

Everything under this heading is tobacco that has not yet been turned into a finished product. Once tobacco is made into cigars, cigarettes or other products, it moves to a different heading in Chapter 24.

HS 2401 six-digit codes: 240110, 240120, 240130

Heading 2401 splits into three codes. The split depends on one question: has the stem been removed from the leaf?

  • 240110, tobacco not stemmed or stripped. The leaf still has its stem. Many traders call this unstripped tobacco.
  • The stem has been taken out of the leaf, either in part or fully.
  • 240130, tobacco refuse. This is waste from tobacco, not usable leaf.

How to choose between 240110, 240120 and 240130

Start with the state of the goods. If they are waste or scraps of tobacco, use 240130. If they are leaf, look at the stem.

Leaf with the stem still in place goes to 240110. Leaf with the stem removed, in part or in full, goes to 240120. The words "partly or wholly" mean you do not need a perfectly stripped leaf to use 240120.

People often ask which HS code to use for tobacco leaf. The answer is one of the first two codes, based on stemming. Wrapper tobacco that is still raw leaf follows the same rule. If you are unsure, try the HS code classifier before you file.

HS 2401 vs 2402, 2403 and 2404

The other headings in Chapter 24 cover tobacco that has been made into something. Heading 2401 is the only one for raw tobacco and refuse.

These are finished smoking products, so they are never classified under 2401.

It includes homogenised or reconstituted tobacco, and tobacco extracts and essences. That is the main difference between HS 2401 and 2403: tobacco in 2401 is unmanufactured, while tobacco in 2403 has been processed.

Heading 2404 is for products meant for inhalation without combustion, and for other nicotine products taken into the body. A quick test helps. A finished product points to 2402, 2403 or 2404.
