What HS code 0812 covers
Provisional means temporary. The goods are treated just enough to stay safe while they travel or wait for processing. A buyer cannot open the pack and eat the contents.
Think of cherries packed in a salt solution before they are made into candied fruit. They are no longer fresh. They are also not ready for the shop shelf. That in-between stage is what this heading is for.
Some traders search for the same heading as HSN code 0812. The number is the same. The World Customs Organization sets the first six digits, and this heading sits in Section II, Vegetable Products, inside Chapter 08.
Codes under HS 0812: 081210 and 081290
The split is simple. It depends on the kind of fruit, not on the way it was preserved.
Use 081290 for every other fruit or nut in this heading. The 081290 line says n.e.c., which means not elsewhere classified. It is the catch-all for anything that is not a cherry.
If you are unsure which line fits your goods, the HS code classifier can help you check before you file.
- 081210: cherries, provisionally preserved
- 081290: other fruit and nuts, provisionally preserved
How 0812 differs from 0809, 0811, 0813 and 0814
Most mistakes happen between neighbouring headings. The state of the goods decides the heading.
Fresh cherries do not belong here. They go to 0809, which covers apricots, cherries, peaches, plums and sloes in fresh form. Frozen fruit and nuts go to 0811, which covers goods cooked by steaming or boiling in water, or uncooked, then frozen. Dried fruit goes to 0813, along with mixtures of nuts or dried fruits.
So, is dried fruit classified under 0812 or 0813? Dried fruit is not provisionally preserved, so it goes to 0813 in most cases. Check the wording of that heading for the exact limits.
Heading 0814 is the closest match in method. It covers peel of citrus fruit or melons, including peel kept in brine, in sulphur water or in other preservative solutions. If the goods are peel, use 0814. If the goods are fruit or nuts kept in a preservative solution, look at 0812. Fruit preserved in brine or sulphur water is a 0812 question only when it is not peel.
