What HS code 0802 covers

Think of this heading as the main shelf for edible tree nuts in the Harmonized System. The word other matters. Three nuts have their own heading next door, so they are not counted here.

A nut may be whole in its shell, shelled or peeled. It must be fresh or dried. Chapter 08 is about fruit and nuts, so these goods sit beside edible fruit.

Almonds, hazelnuts (also called filberts), walnuts, chestnuts, pistachios, macadamia nuts and pine nuts each get codes of their own. Kola nuts and areca nuts are listed here too.

HS 0802 subheadings by nut: in shell vs shelled

Most nuts come in pairs. The first code is for nuts still in the shell. The second is for nuts with the shell removed. Read across each line to find your nut.

  • Almonds | in shell 080211 | shelled 080212
  • Hazelnuts or filberts | in shell 080221 | shelled 080222
  • Walnuts | in shell 080231 | shelled 080232
  • Chestnuts | in shell 080241 | shelled 080242

  • Macadamia nuts | in shell 080261 | shelled 080262
  • Pine nuts | in shell 080291 | shelled 080292

  • Nuts with no name of their own | one code, 080299

How to pick the right subheading

Use three steps. Each one shortens the list.

Step one: name the nut. A pair of codes exists for most of them. Kola and areca nuts have a single code, so shelling makes no difference.

Step two: look at the shell. A walnut still in its shell takes 080231, while a shelled one takes 080232. The same idea works for every paired nut.

Step three: if the nut is not named anywhere, consider 080299. It is the catch-all for edible nuts that neither of the two nut headings names. Try it only after you rule out the named codes.

Nuts that are not in 0802

Cashews are a common question. Coconuts, Brazil nuts and cashews are all classed in heading 0801.

The state of the goods matters too. Nuts kept briefly in brine or a similar liquid, and unfit to eat as they are, move to heading 0812.

Blends are another case. A mix of nuts, or of nuts and dried fruit, goes to heading 0813. A single kind of nut, fresh or dried, stays here.
