What heading 2202 covers
Heading 2202 is for drinks that have no alcohol and are not plain water or juice. It sits in Chapter 22 (beverages), inside Section IV. Think of soft drinks, sweetened sparkling water, flavoured mineral water and non-alcoholic beer.
The heading splits into three subheadings. Each one has a plain meaning:
- 220210: aerated waters, mineral waters and other waters that have added sugar, added sweetener or a flavour. Flavoured water and sweetened water go here.
- 220291: non-alcoholic beer. It is the only subheading named after one product.
- 220299: every other non-alcoholic beverage that does not fit the two codes above. Fruit, nut or vegetable juices are left out.
How to choose the right 2202 code
Tariff classification is easier when you ask a few short questions in order. Start with the main ingredient and the way the drink is made.
First, ask if the product is water with sugar, a sweetener or a flavour added. If yes, use 220210. Sparkling water with a fruit taste is a common example.
Next, ask if the product is beer with no alcohol. If yes, use 220291. Do not confuse it with 2203, which is beer made from malt.
If the drink has no alcohol but fits neither case, use 220299. Soft drinks that are not water-based often end up here.
If you are still unsure, the HS code classifier can help you narrow it down.
HS 2202 vs 2201 and juices
The difference between 2201 and 2202 is sugar and flavour. Heading 2201 covers natural or artificial mineral waters and aerated waters with nothing added. It also covers ice and snow. Once sugar, sweetener or flavour is added, the drink moves to 2202.
Fruit juice is a different case. Juices have their own heading, and the wording of 2202 says they are not included.
A simple rule helps. Plain water goes to 2201. Juice goes to its own heading.
