What HS code 3301 covers
Heading 3301 is where customs places natural essential oils. Aromas can be taken out of plants in several ways, and this heading follows those ways. Concretes and absolutes sit here. So do resinoids and extracted oleoresins.
Some goods are made by enfleurage or maceration. In both, plant material is soaked in fat or oil so the scent moves into it. The heading also takes in aqueous distillates, which are water-based, along with solutions and terpenic by-products of these oils.
Chapter 33 is about perfumery and cosmetics, and 3301 is the raw-material end of it. Many traders know the same number as HSN code 3301.
How to choose the right 3301 subheading
Ask three short questions, in this order.
First: is it a citrus oil? Orange and lemon each have a named line. Any other citrus fruit falls into the third citrus line. Second: is it a mint oil? Peppermint from Mentha piperita is kept apart from all other mints, so check the plant's Latin name on the supplier's papers. Third: is it a resinoid? Resinoids have a line of their own and nothing else goes there.
If none of these fit, look at 330129. It takes essential oils that no other line names. Use 330190 only for the forms that are not a plain oil: concentrates in fats, fixed oils or waxes, terpenic by-products, distillates, solutions and extracted oleoresins.
Every oil line says "terpeneless or not". So taking the terpenes out of an oil does not change its line. Concretes and absolutes follow the oil they come from.
3301 vs nearby headings in Chapter 33
Mix-ups often happen with the headings that come next. A good test is to ask whether the product is a natural oil or extract, or whether it has been turned into something else.
Once aroma substances are blended, the goods usually move to 3302. Once they are finished as a scent for the skin, they move to 3303. Skin care, hair, mouth and shaving products sit further along, in 3304 to 3307. A finished product is not an essential oil, even if oil is its main ingredient.
If you are still unsure, run the product through the HS code classifier before you file.
